9th U.S. Circuit Court of Appeals Block Presidents Travel Ban

New York, NY – With the eyes of the World on San Francisco, a panel of three Federal Judges from the 9th U.S. Circuit Court of Appeals unanimously handed down the decision to decline the travel ban handed down by President Donald Trump via executive order.  The refusal to reinstate the ban on travel from seven predominantly Muslim nations holds the premise that the executive order unconstitutionally blocks entry based on religion. U.S. District Judge James Robart of Seattle issued the initial temporary order halting the ban last week after Washington State and Minnesota sued.

The Ruling

The President of the United States has the constitutional power to restrict the entry into the U.S.  However, from a general census, the travel ban harmed Muslims as well as those with green cards who followed the process to seek citizenship as a U.S. Citizen. After today’s ruling, people from the seven countries — Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen — with valid visas can resume travel to the U.S.

 

Kellyanne Conway, senior counselor to Trump, has been speaking to Fox News:

The nation’s safety is at risk. That’s what this has always been about from the beginning … keeping the country safe.

It’s not just a promise he made as a candidate, it is his duty and responsibility as president of the United States and commander-in-chief.

And in fact he has broad authority to do that under the statute.

This ruling does not affect the merits at all. It is an interim ruling and we are fully confident that now that we will get our day in court and have an opportunity to argue this on the merits that we will prevail.
